3. Communications — Phone, SMS, and AI Agents
By providing your phone number and submitting our contact form (or otherwise requesting contact by phone), you expressly consent to being contacted by DUNNAI via phone call or SMS, including communications initiated or handled by an AI-powered phone agent.
The following terms govern all phone and SMS communications:
- Consent is required: We will only contact you by phone or SMS if you have provided your phone number and indicated consent through our contact form, a verbal agreement, or a written agreement.
- AI agent disclosure: When you receive or place a call handled by our AI phone agent service, you will be informed at the beginning of the call that you are interacting with an AI-powered assistant. Calls may be recorded for quality and service improvement purposes.
- Consent logging: Your consent decision (granted, declined, or timeout) is logged at the start of every AI agent call before the conversation proceeds. Each record captures the timestamp, your phone number, the Twilio Call SID, consent method, and script version. Records are retained for a minimum of 2 years. The consent log is publicly viewable at ericwdunn.com/consent_log.html. You may request a copy or deletion of your individual record by contacting us.
- Opt-out: You may opt out of SMS communications at any time by replying STOP to any text message. You may opt out of phone contact by emailing [email protected] or calling +1 (832) 603-2966.
- No marketing sharing: Your phone number and SMS opt-in data will not be shared with third parties for marketing or advertising purposes under any circumstances.
- Message frequency: Message frequency varies based on your inquiry and project engagement. Standard message and data rates may apply.
4. Client Engagements and Project Agreements
Services are provided under separate project agreements or statements of work that govern deliverables, payment terms, timelines, and ownership of work product. In the event of a conflict between these Terms and a project agreement, the project agreement controls.
Unless otherwise specified in writing:
- Payment is due per the schedule in the project agreement
- Client retains ownership of custom code and deliverables upon full payment
- DUNNAI retains the right to reference the engagement as a case study (without disclosing confidential business information)
5. Acceptable Use
You agree not to use our website or services to:
- Engage in any unlawful activity or facilitate illegal acts
- Transmit spam, unsolicited messages, or harmful code
- Misrepresent your identity or affiliation
- Interfere with or disrupt the integrity or operation of our services
6. Intellectual Property
The DUNNAI name, logo, website content, and proprietary tools developed by DUNNAI remain the intellectual property of Eric W. Dunn unless explicitly transferred in writing. You may not reproduce or use our branding or proprietary materials without permission.
7. Disclaimer of Warranties
Our website and services are provided "as is" without warranties of any kind, express or implied. We do not warrant that services will be uninterrupted, error-free, or that results will meet every specific requirement. AI-generated outputs are provided as a tool and should be reviewed by a qualified human before acting on them in critical business decisions.
8. Limitation of Liability
To the fullest extent permitted by law, DUNNAI and Eric W. Dunn shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim arising from our services shall not exceed the fees paid by you to DUNNAI in the 90 days preceding the claim.
9. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in San Jacinto County, Texas.
